When Is Fire-Rated Accommodation Required?
More than 6 m clear fire break
If a 6m+ separation is achievable, no fire-rated construction is needed – unless you stack units. Stacked floors then require a 30 min integrity (REI) and 30 min insulation (R) rating to BS EN 13501-2 (or BS 476 equivalent).
Less than 6 m clear fire break
Where you cannot provide a 6m separation, all buildings must comply with JCoP 10.2 section 13.3 fire-performance criteria. Units built before 1 Jan 2025 to JCoP 9th Edition section 13.3 may remain in use; those built after must meet the JCoP 10.2 requirements.
